This paper deploys Laclau and Mouffe's discourse theory to examine the dispute over intellectual property protection and global HIV/aids medicines access. Over the 1980s and 1990s, major pharmaceutical companies and minority world governments successfully crafted a strong patent protection regime, institutionalized in the World Trade Organization's intellectual property rules. In the early 2000s, a transnational civil society campaign challenged this regime, positioning patents at the centre of a highly publicized dispute. This dispute has been retrospectively identified as a turning point (...) in medicines access discourse, with the 2001–2003 period dubbed the ‘golden window’ for expanded global HIV/aids medicines access. However, this ‘window’ has also been critiqued as an unsustainable aberration to a continuing hegemonic regime that prioritizes patent protection, to the detriment of equitable global medicines access. This paper draws on both political economy analyses and discourse theoretical concepts to examine the processes of rupture and suture in HIV/aids medicines access discourse. (shrink)

In spite of ethical analyses assimilating the palliative deactivation of pacemakers to commonly accepted withdrawings of life-sustaining therapy, many clinicians remain ethically uncomfortable with pacemaker deactivation at the end of life. Various reasons have been posited for this discomfort. Some cardiologists have suggested that reluctance to deactivate pacemakers may stem from a sense that the pacemaker has become part of the patient’s “self.” The authors suggest that Daniel Sulmasy is correct to contend that any such identification of the pacemaker is (...) misguided. The authors argue that clinicians uncomfortable with pacemaker deactivation are nevertheless correct to see it as incompatible with the traditional medical ethics of withdrawal of support. Traditional medical ethics is presently taken by many to sanction pacemaker deactivation when such deactivation honors the patient’s right to refuse treatment. The authors suggest that the right to refuse treatment applies to treatments involving ongoing physician agency. This right cannot underwrite patient demands that physicians reverse the effects of treatments previously administered, in which ongoing physician agency is no longer implicated. The permanently indwelling pacemaker is best seen as such a treatment. As such, its deactivation in the pacemaker-dependent patient is best seen not as withdrawal of support but as active ending of life. That being the case, clinicians adhering to the usual ethical analysis of withdrawal of support are correct to be uncomfortable with pacemaker deactivation at the end of life. (shrink)

Todd Moody’s Zombie Earth thought experiment is an attempt to show that ‘conscious inessentialism’ is false or in need of qualification. We defend conscious inessentialism against his criticisms, and argue that zombie thought experiments highlight the need to explain why consciousness evolved and what function(s) it serves. This is the hardest problem in consciousness studies.

Wilhelm (Forthcom Synth 199:6357–6369, 2021) has recently defended a criterion for comparing structure of mathematical objects, which he calls Subgroup. He argues that Subgroup is better than SYM \(^*\), another widely adopted criterion. We argue that this is mistaken; Subgroup is strictly worse than SYM \(^*\). We then formulate a new criterion that improves on both SYM \(^*\) and Subgroup, answering Wilhelm’s criticisms of SYM \(^*\) along the way. Psychiatric disorders can pose problems in the assessment of decision-making capacity (DMC). This is so particularly where psychopathology is seen as the extreme end of a dimension that includes normality. Depression is an example of such a psychiatric disorder. Four abilities (understanding, appreciating, reasoning and ability to express a choice) are commonly assessed when determining DMC in psychiatry and uncertainty exists about the extent to which depression impacts capacity to make treatment or research participation decisions.

The author, who has been on the faculty at the University of St. Thomas in St. Paul, Minnesota, for (...) the last few years, originally wrote a much longer manuscript, "Interrelatedness: A Comparison of the Spiritualities of St. John of the Cross and Buddhaghosa for the Purpose of Examining the Christian use of Buddhist Practices," which was approved for the PhD degree at the Graduate Theological Union in 1996. Christianity Looks East is [End Page 216] almost half the length of the dissertation and written in nontechnical terms accessible to the interested layperson (although there is a very helpful "Glossary of Terms" in the back of the book).Feldmeier's primary question concerns the possibility of taking the interreligious dialogue to the next level of spiritual practice. Succinctly put, his hypothesis is that, yes, this next level of dialogue and exploration is possible, but the complexities involved need to be approached cautiously. Five chapters structure the development of this line of thought.Chapter 1 summarizes the state of the interreligious dialogue and introduces the book's thesis and dialogue partners, the sixteenth-century Christian mystic St. John of the Cross and the fifth-century monk-scholar Bhadantacariya Buddhaghosa, especially his classic commentary The Path of Purification (Vissudhimagga). Chapters 2–4 comprise the main comparative chapters, focused respectively on St. John of the Cross's and Buddhaghosa's anthropologies, their views of the spiritual life, and their understandings of the goals of spiritual disciplines and practices. Each of these middle chapters is divided into three parts: on St. John of the Cross, on Buddhaghosa, and on comparing where their views converge and diverge. Anthropological convergences include a constantly craving human nature, a delusional human consciousness, a desire-driven will, and the remedy of asceticism. Predictably, St. John of the Cross and Buddhaghosa diverge on the nature of the self: as a substantive soul on the one hand, and as impermanent on the other. Their spiritual paths feature detachment from cravings and deconstruction of the self's egotistical desires, but part ways in terms of St. John's emphasis on divine initiative and the practice of self-emptying love versus Buddhaghosa's emphasis on self-cultivation and the practice of analyzing phenomena. "Final bliss" (the title of chapter 4) presents convergent goals of absolute freedom and perfect peace, but different views of loving identification with a personal God (St. John of the Cross) and impersonal entrance into Nirvana (for Buddhaghosa, the cessation of suffering, negatively described as unconditioned).The fifth chapter asks about the future of the Buddhist-Christian dialogue, particularly with regard to interreligious practice. Drawing especially from John Dunne's theory of passing over and then coming back, Feldmeier defends the possibility of Christian use of Buddhist practices. This article presents the first detailed account of Giorgio Benigno Salviati's discussion of the will written in Urbino during the mid-1470s and the early 1480s. A Franciscan friar and a prominent professor of theology and philosophy, Salviati was a prolific author and central figure in the circles of Cardinal Bessarion in Rome and of Lorenzo de' Medici in Florence. This article focuses on his defense of the Scotist theory of the will. It considers its fifteenth-century context, in which both humanist (...) and scholastic thinkers dealt with the question of the intellect and the will. While basing himself partly on authorities such as Aristotle, Augustine, and Thomas Aquinas, Salviati is clearly aware of the novelty of his theory, and its important implications for ethics and theology. A barrier to the development and refinement of ethics education in and across health professional schools is that there is not an agreed upon instrument or method for assessment in ethics education. The most widely used ethics education assessment instrument is the Defining Issues Test (DIT) I & II. This instrument is not specific to the health professions. But it has been modified for use in, and influenced the development of other instruments in, the health professions. The DIT contains certain (...) philosophical assumptions (“Kohlbergian” or “neo-Kohlbergian”) that have been criticized in recent years. It is also expensive for large institutions to use. The purpose of this article is to offer a rubric—which the authors have named the Health Professional Ethics Rubric—for the assessment of several learning outcomes related to ethics education in health science centers. This rubric is not open to the same philosophical critiques as the DIT and other such instruments. This rubric is also practical to use. This article includes the rubric being advocated, which was developed by faculty and administrators at a large academic health science center as a part of a campus-wide ethics education initiative. The process of developing the rubric is described, as well as certain limitations and plans for revision. (shrink)

The 1990’s, we’ve been told, were the decade of the brain. But without anyone announcing or declaring, much less deciding that it should be so, the 90’s were also a breakthrough decade for the study of consciousness. (Of course we think the two are related, but that is another matter altogether.) William G. Lycan leads the charge with his 1987 book Consciousness (MIT Press), and he has weighed-in again with Consciousness and Experience (1996, MIT Press). Together these two books put (...) forth Lycan’s formidable view of consciousness, extending the theory of mind that he calls ‘homuncular functionalism.’ Roughly, Lycan’s view is that conscious beings are hierarchically composed intentional systems, whose representational powers are to be understood in terms of their biological function. In this review we will call the view ‘teleological functionalism’ or ‘teleofunctionalism’ – the homuncular part, for which Lycan and Daniel Dennett argued convincingly, is now so widely accepted that it fails to distinguish Lycan’s view from other versions of functionalism. Driving is central to adult independence and autonomy; yet most autistic young adults do not acquire driver’s licenses. It is important to understand barriers to achieving this milestone for autistic adults. Differences in negative affect and emotion dysregulation associated with autism may interfere with managing difficult driving situations. The current study compared perceived driving difficulty, emotion dysregulation, and negative affect in emerging drivers with and without autistic traits, and investigated how emotion dysregulation and negative affect relate to perceived DD. We (...) expected greater perceived DD, emotion dysregulation, and negative affect in participants with AT and a positive correlation of perceived DD with both emotion dysregulation and negative affect in the whole sample. Thirty-seven adolescents and young adults self-reported perceived DD in 15 scenarios and completed the Difficulty in Emotion Dysregulation Scale and the Depression, Anxiety, and Stress Scale. Autistic participants scored significantly higher on mean perceived DD, DERS Impulse subscale, DASS total and DASS Stress subscale scores. Perceived DD positively correlated with the DERS and DASS total scores, all DASS subscales, and DERS Nonacceptance, Goals, and Impulse subscales across the whole sample. The findings highlight the roles of emotion dysregulation and negative affect in perceived DD in emerging drivers with AT. In particular, emotional stress and impulsivity may map onto mechanisms of over-reactivity to negative affect and explain why autistic people perceive particular situations as difficult when driving. ABSTRACT This article examines the reaction to Owen’s work in the circle associated with the liberal Journal des Économistes. It attempts to reconstruct the liberal argument against utopian socialist schemes of ‘regeneration’ and ‘redistribution’, and against those associated with Robert Owen in particular. It focuses on the works of Louis Reybaud (1799–1879) and Adolphe Blanqui (1798–1854) and their critical engagement with the writings of Saint-Simon, Fourier and Owen. It offers a detailed analysis of Reybaud’s Études sur les (...) réformateurs, ou socialistes modernes (1840), which did much to popularise the term ‘socialist’ in France, and Blanqui’s Histoire de l’économie politique en Europe depuis les anciens jusqu’à nos jours (1837). The article’s central argument is that these works appeared at an inflection point in the history of liberal political economy in France. Both started from the premise, shared with the socialist authors they were analysing, but increasingly suspect to liberal economic opinion, that the solution to the social question lay in the proper harnessing of the spirit of association as opposed to unregulated competition. The question at issue for Blanqui and Reybaud was what form this ‘associationism’ should take. (shrink)

In face of the multiple controversies surrounding the DSM process in general and the development of DSM-5 in particular, we have organized a discussion around what we consider six essential questions in further work on the DSM. The six questions involve: 1) the nature of a mental disorder; 2) the definition of mental disorder; 3) the issue of whether, in the current state of psychiatric science, DSM-5 should assume a cautious, conservative posture or an assertive, transformative posture; 4) the role (...) of pragmatic considerations in the construction of DSM-5; 5) the issue of utility of the DSM – whether DSM-III and IV have been designed more for clinicians or researchers, and how this conflict should be dealt with in the new manual; and 6) the possibility and advisability, given all the problems with DSM-III and IV, of designing a different diagnostic system. Part 1 of this article took up the first two questions. Part 2 took up the second two questions. Part 3 now deals with Questions 5 & 6. Question 5 confronts the issue of utility, whether the manual design of DSM-III and IV favors clinicians or researchers, and what that means for DSM-5. Our final question, Question 6, takes up a concluding issue, whether the acknowledged problems with the earlier DSMs warrants a significant overhaul of DSM-5 and future manuals. As in Parts 1 & 2 of this article, the general introduction, as well as the introductions and conclusions for the specific questions, are written by James Phillips, and the responses to commentaries are written by Allen Frances. In this 6-year, multi-study paper we summarize a new and effective framework of single-session problem-solving developed in an elite sport context at a world leading national institute of sport science and medicine. In Study 1, we used ethnography to observe how single-session problem-solving methods were being considered, explored, introduced and developed within the EIS. In Study 2, we used case-study methods split into two parts. A multiple case-study design was employed in Part one to evaluate how the approach was refined (...) into an effective framework of practice. An individual case-study is then illustrated to detail the framework in-action. Collectively, findings realized a framework of single-session problem-solving for use both inside and outside of elite sport that focused on ways to reframe clients’ problems into more ‘solvable’ descriptions. Guidance for psychologists wishing to integrate these problem-solving techniques into their practice are offered. (shrink)

The first session was titled “The Boundaries of Knowledge in Buddhism, Christianity and Science.” The theme for the second session was “Buddhist-Christian Dialogue in an Age of (...) Science.”The first session, a panel discussion of The Boundaries of Knowledge in Buddhism, Christianity and Science, edited by Paul Numrich (Göttingen: Vandenhouek and Rupricht, 2008), considered the epistemological questions raised by Buddhist, Christian, and scientific insights on the inadequacies of conceptualization and language for understanding reality. The project that produced the book was funded by the Templeton Foundation, which also generously supported this panel.After a welcome by moderator Miriam Levering (University of Tennessee), the book’s editor, Paul Numrich (Theological Consortium of Greater Columbus), gave a brief overview of the volume, followed by reflections on their chapters by two contributors: Dennis Hirota (Ryukoku University) and Paul Ingram (Pacific Lutheran University). Amos Yong (Regent University School of Divinity) responded to Hirota’s chapter, and Sandra Costen Kunz (Phillips Theological Seminary) responded to Ingram’s. Hirota and Ingram each made a few remarks on these responses, leading into an open discussion including other contributors to the book: John Albright (Lutheran School of Theology), Roger Blomquist (Argonne National Laboratory), Tom Christenson (Capital University), and David McMahan (Franklin and Marshall College).Hirota’s paper, based on his chapter “Shinran and Heidegger on Truth,” examined the epistemology of Shinran (1173–1263), founder of the Japanese Shin Pure Land Buddhist tradition. Hirota noted that for both Shinran and Martin Heidegger (1889–1976) [End Page 197] truth is less a matter of asserting propositions and more a matter of the recognition and turning away from prior perceptual distortion. This permits the emergence of a new structure of awareness, an emergence that parallels Thomas Kuhn’s paradigm shifts in scientific understanding.In his response, Yong called for a greater role for different “particularistic or even confessional approaches” within “the religion-science discussion.” He thus noted with appreciation the grounding of Hirota’s paper in a Buddhist tradition that is not “broadly Tibetan,” like much work in Buddhist-science dialogue. He compared and contrasted Shinran’s teachings about the corruption and purification of human reason with those of the Council of Dordt’s five-point condensation of Protestant reformer John Calvin’s soteriology, pointing out that both have a salvific intention.Ingram argued that while science has amassed reliable information about physical reality, and Buddhist and Christian practitioners have amassed reliable knowledge about the structures of human experience, all three traditions confront epistemological boundaries imposed by their methods of inquiry. Questions arising at these boundaries form the foundation for a science-Buddhism-Christianity trialogue. Noting that science demonstrates that “nature is rooted in a realm... only half-translated into our phenomenal experience,” Ingram reviewed how scientists and Buddhist and Christian practitioners “work back from relevant experiences on the phenomenal level, and then ask what hypothetical reality might constructively explain these experiences.”Kunz pointed out that in his examples of “working back” from experience toward hypotheses, Ingram cites many reasons for epistemological humility. Noting her research on how methods of Christian spiritual discernment might yield hypotheses for reducing the ecological crisis, she argued that Christians who have ignored the boundaries of human knowledge have contributed to this crisis. She suggested that if Western Christians who teach spiritual discernment took Buddhist and current neuroscience insights about human knowing more seriously, their teaching practices might differ less from those of non-Western Christians.The second session, chaired by Amos Yong (Regent University), was a roundtable discussion of Paul O.
